Terms of Service

These Terms govern your use of FounderHire.ai ("FounderHire," "we," or "us") and the services we provide. By using our website, signing up, or paying for a package, you agree to these Terms.
1. Who we are
FounderHire.ai is operated from New York. Contact: hello@founderhire.ai.
2. What we provide
Website design and build, ongoing hosting, software maintenance, and (depending on the package you choose) automated lead follow-up, AI chat, and AI voice services. The specific deliverables for your plan are described on /packages and confirmed in your order summary at checkout.
3. Payment, billing, and refunds
Each package has a one-time setup fee plus a recurring monthly software-and-maintenance fee. Current pricing (Starter $500 / $49 mo, Growth $750 / $79 mo, AI Assistant $1,000 / $129 mo, AI Operator $1,300 / $199 mo) is on /packages and the order summary you see at checkout. The setup fee is charged at checkout; the monthly fee recurs every 30 days starting on the checkout date. Payments are processed by Stripe in live mode.
Refunds. The setup fee is refundable within 7 days of checkout if we have not yet delivered the preview. Monthly fees are not refundable, but you can cancel at any time and we will not bill you for the next cycle. Cancellation takes effect at the end of the current billing period.
Failed payments. If your card fails we email you, give a grace period, and then pause your site after 14 days of non-payment (your site shows a temporary maintenance page rather than going down). After 30 days of non-payment the subscription is cancelled and your site is archived read-only for 90 days.
4. Intellectual property
Your content. Anything you give us — business name, photos, copy, customer data, voice call recordings — remains yours. You grant us the rights needed to host, display, and process it on your behalf for the duration of the agreement.
Your finished site. Each paid customer gets a dedicated private GitHub repository (FounderHireCEO/client-<your-slug>) containing the Next.js codebase we generate and iteratively edit for you. Once paid in full, the code in that repository is yours; on request after cancellation we transfer repository ownership to a GitHub account you control.
Our platform. The FounderHire platform itself — including the wizard, AI agents (Build Agent, Reviewer Agent, Chatbot, Voice Receptionist), reusable section components, prompt engineering, and infrastructure automation — remains our property and is licensed to you only for use of the services.
5. Service availability
We target high availability but do not guarantee uninterrupted service. Scheduled maintenance, third-party outages (AWS, Stripe, Anthropic, etc.), and emergency fixes may cause temporary disruption. No SLA credits are offered at current pricing tiers.
6. Acceptable use
Don't use our services for anything illegal, deceptive, or that infringes on others' rights. No spam, scraping, malware, or content that violates third-party terms (e.g., GBP, Stripe, or common-carrier rules). We can suspend or terminate accounts that violate this section without notice.
7. Termination
Either party can cancel for any reason. If you cancel, we stop billing at the end of the current period. If we cancel for a violation, we may revoke access immediately. After termination we hold your data for 90 days in case you want to reactivate, then it's deleted.
8. Disclaimers
Services are provided "as is" and "as available." To the maximum extent permitted by law, we disclaim all warranties, express or implied, including fitness for a particular purpose and non-infringement. We do not warrant that the services will be error-free or generate any specific business outcome.
9. Limitation of liability
To the maximum extent permitted by law, our total liability arising from your use of the services is limited to the amount you paid us in the 12 months preceding the claim. We are not liable for indirect, incidental, consequential, or punitive damages, including lost profits or lost data.
10. Governing law
These Terms are governed by the laws of the State of New York, without regard to conflict of laws principles. Disputes must be brought in the state or federal courts located in Suffolk County, New York.
11. Changes
We may update these Terms. When we do we'll update the "Last updated" date and post the new version here. Continued use after a change means you accept the updated Terms.
